(VAN NUYS, CA) — The U.S. Supreme Court decision today to strike down the Child Pornography Act is a victory for Hollywood and the government, according to legal expert Mark Kernes, senior editor of Adult Video News Magazine (AVN) the trade magazine of the adult industry.
"The most important point is that the Court has now drawn a very bright line between young looking adults and actual minors," said Mr. Kernes, who is also a board member of the Free Speech Coalition. "This is an enormous victory for Hollywood, because it means the studios won’t have to recall coming-of-age films such as "Fast Times at Ridgemont High," "Tin Drum," and "The Last Picture Show," all classics that would have been considered child porn under the CPPA."
"Child pornography is actually child sexual abuse, and that is not what people in the adult entertainment industry do or support," said Mr. Kernes. "Our industry fought the fight, but everyone in the entertainment industry and the public are the real winners."
Mr. Kernes noted that the Supreme Court decision is "also a victory for the government because now it can spend its time more properly prosecuting actual child pornographers and people who are actually abusing children."
