(SAN DIEGO, CA) — The long-brewing legal dispute between Matt Krivicke/Lovable Dolls and Matt McMullen/RealDoll will go to trial on Monday April 12th, 2010 in the San Diego Superior Court in Vista. The lawsuit started as a simple contract dispute filed by Krivicke against Abyss Creations/McMullen (maker of RealDoll) in August of 2008 after Krivicke was laid off. Krivicke is claiming unpaid profit sharing as well as fraud claims against McMullen. Abyss responded by countersuing Krivicke and his company KnightHorse (maker of Lovable Dolls) for unfair competition, and use of intellectual property/trade secrets.
The lawsuit will finally reach its climax in front of the jury next week. The case is being held in open court and is expected to run for 2 weeks before a decision is reached. The courthouse is anxious for this interesting case to start due to the novel subject matter. With life size silicone love dolls at the center of the dispute, jurors can expect to see several doll ”witnesses” present in the courtroom. Some may consider this a life size Barbie Vs. Bratz case…
