Adult Industry News received a letter from Max Hardcore who is in the Metropolitan Detention Center in Los Angeles. The letter was dated July 16, 2009. The following are his words.
Dear Steve,
I hope that when these few lines reach you, that they will find you in good spirits, and best of health, with a smile on your face. I’m pleased to report that I’m doing well, despite the drab surroundings and mind-numbing boredom of the notorious Metropolitan Detention Center in downtown L.A., where I am being held against my will for the alleged crime of making adult movies for adults. Through it all however, I am keeping a positive attitude, because I know that my cause is just. I am not a criminal, I am a victim of an ongoing crime of censorship. When they declared me guilty in Florida, they said what I did was wrong. Yet, so did our founding fathers, under the penalty of death by dismemberment, when they wrote and adopted the Constitution which guarantees the freedom of speech, and the privacy of a person, especially in their home.
Despite my conviction in Tampa, which is the true obscenity, not a single person from that area had complained about my movies. In fact, I didn’t even send the movies to Tampa. That was done by a distributor whom I barely know, who sent my European versions with more explicit action to Tampa, without my knowledge or consent. In what we feel is an illegal tactic, the prosecutor charged me with shipping instead of the distributor, even though we have separate versions available for the US market, and that is all we have ever shipped within the United States.
With the assistance of my attorney, the 1st Amendment champion H. Louis Sirkin, I will present my case for reversal in the 11th Circuit Court of Appeals in late October. We have multiple and mighty arguments for dismissal, and are hopeful for a full vindication of all the unjust verdicts. We are even challenging the very constitutionality of the obscenity law itself, and hope to relegate it to the trash-heap of legal history where it belongs!
In the mean time, I’m making the most of my time away from family, friends, and career to improve myself, so that when I finally emerge from this illegal confinement, I’ll be a better man than I ever was. A man who puts others before himself. I’ve put a lot of people to work in the past, and helped even more out in many ways. But when I do go back to work, my goal is to do more in the next 10 years than I did for others in the last 40.
